How does it work?


SHOULD ANY PASSENGER EXPERIENCE THE FOLLOWING SITUATIONS EITHER ON A SCHEDULED FLIGHT OR IN CASE OF A CHARTER FLIGHT:

  1. Delayed departure in excess of 3 hours
  2. Flight cancellation not communicated at least 14 days prior to the cancellation itself (with the exception of flights cancelled due to force majeure, i.e. situations the airline could not influence or prevent from happening, for example severe weather conditions, etc.)
  3. Involuntary exclusion from flight (so called commercial overbooking)

then each and every passenger of the respective airline is entitled to:

  1. Refreshments and accommodation, alternatively
  2. Full refund of travel costs or re-routing to a different flight
  3. Financial compensation

The financial compensation in the above described situations is structured as follows:

  1. 250 EUR for flights of up to 1500 km
  2. 400 EUR for flights from 1500 km to 3500 km
  3. 600 EUR for flights longer than 3500 km

However, most of the passengers do not exercise their rights properly or simply do not even know about their rights! It is either due to the fact they are not aware of their rights, but also due to the complexity of the claim procedure (the passenger often times has to deal with the claim in a foreign language; must find out who to contact; communicate with respective customer care centres of the respective airline; prove that the conditions for financial compensation have been met, etc.).

The Council of European Union drafts and approves numerous bills and acts that protect European citizens and the European consumer market while offering the consumers a possibility to exercise their rights in a lawful way.


In this respect one should notice the currently valid Regulation (EC) No. 261/2004 of the European Parliament and of the Council, that reinforces the rights of passengers using air transportation in case of “operational air traffic irregularities” in a significant manner. This Regulation is applicable to all EU airlines and their flights operated in both directions and to all departures from European airports even if operated by a non-European airline.


WHAT IS THE PROCESS?

The registration process shall not take more than 5 minutes of your time and at this stage we do not ask for any detailed personal information. We just need the very basic information that will allow us to perform the following:


  1. Verify the flight stated and find out whether or not it can be subject to financial compensation
  2. Verify that the passenger was really booked on the flight and boarded the flight.

Our Skyplan.eu system then “communicates” the data with other systems and checks the parameters of all flights performed within the EU.


Once the right for financial compensation claim is confirmed we ask the client to provide additional information. Our team of experts at Skyplan.eu then takes care of communication with the respective airline. In a close co-operation with our lawyers we are prepared to get the compensation paid even with the help of legal action.


Once the airline transfers the financial compensation, we credit our client´s account with the agreed amount.
